Terms of Service - DrinkCountr

1. Agreement to Terms

By accessing or using DrinkCountr ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

DrinkCountr is operated by DrinkCountr ("we", "us", or "our"). The Service is available at drinkcountr.com and related domains.

2. Description of Service

DrinkCountr is a drink tracking application designed for home bar hosts and party organisers. The Service allows users to:

Track drink consumption at private events
Calculate fair cost splitting among guests
Display live scoreboards for entertainment
Monitor keg levels (Premium feature)

The Service is intended for personal, non-commercial use at private gatherings. It is not intended for use by licensed commercial establishments.

3. User Accounts

3.1 Registration

To use certain features of the Service, you must register for an account. You agree to:

Provide accurate and complete registration information
Maintain the security of your account credentials
Notify us immediately of any unauthorised access
Accept responsibility for all activities under your account

3.2 Age Requirements

You must be at least 18 years old to create an account and use the Service. By using DrinkCountr, you represent that you are of legal drinking age in your jurisdiction.

4. Acceptable Use

You agree not to use the Service to:

Violate any applicable laws or regulations
Encourage excessive or irresponsible alcohol consumption
Track drinks for minors or anyone under legal drinking age
Operate a commercial bar or licensed establishment
Interfere with or disrupt the Service or servers
Attempt to gain unauthorised access to any part of the Service
Use the Service for any illegal or harmful purpose

5. Subscriptions and Payments

5.1 Free and Premium Tiers

DrinkCountr offers both free and premium subscription tiers. The free tier includes basic features with limitations. Premium subscriptions unlock additional features as described on our pricing page.

5.2 Billing

Premium subscriptions are billed in advance on a monthly or annual basis. Payments are processed securely by Stripe. We do not store your payment card details.

5.3 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation, you will retain access to premium features until the end of your current billing period. No refunds are provided for partial billing periods.

5.4 Price Changes

We reserve the right to modify subscription prices. Any price changes will be communicated in advance and will apply to subsequent billing periods, not current subscriptions.

6. Intellectual Property

The Service and its original content, features, and functionality are owned by DrinkCountr and are protected by international copyright, trademark, and other intellectual property laws.

You retain ownership of any data you input into the Service (drink names, guest names, etc.). By using the Service, you grant us a limited licence to process this data solely for providing the Service to you.

7. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

You are responsible for obtaining appropriate consent from guests whose information you input into the Service.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

Merchantability or fitness for a particular purpose
Accuracy or reliability of any information obtained through the Service
Uninterrupted or error-free operation

Important: DrinkCountr is a tracking tool only. We do not encourage excessive alcohol consumption. Please drink responsibly and be aware of your limits. The Service should not be used to pressure anyone to drink more than they wish to.

9. Limitation of Liability

To the maximum extent permitted by law, DrinkCountr shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

Loss of profits, data, or goodwill
Service interruption or computer damage
Any damages arising from your use of the Service

Our total liability for any claims under these Terms shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless DrinkCountr and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

Your use of the Service
Your violation of these Terms
Your violation of any rights of another party

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. You may request deletion of your data by contacting us.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Service and updating the "Last updated" date.

Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.
